Automation Account Terms of Service

OVERVIEW

This Agreement is between you (The Client) and Sites At Scale Pty Ltd (ABN 115 11 657 040 689) (us, we or our) and relates to the engagement of our service known as “Go High Level” or “Service Provider” where we will provide you with a customised software platform and ongoing support to help you reduce the cost of running your studio and improve the number of leads you convert.

SECTION 1 – SETUP FEES

The Go high Level Service starts with the payment of your Set-Up Fee, which is currently US$1000.
This fee covers; setting you your Go High Level platform, editing account details, adding your custom colours and branding, importing your contacts and providing platform training. This fee must be paid in full upon placing an order on your website. This fee is non-refundable.

SECTION 2 – ONBOARDING AND SETUP PROCESS

After placing an order you will be required to complete an onboarding form online before receiving access to Google Documents with all the email, task and sms content that is inside the Go High Level platform. You will be required to update this content inside Go High Level after we complete the build of your platform, so we suggest you begin editing this content in preparation for receiving the completed platform. We will hand over access to your platform within (10) ten working days. Upon handover we will provide you with documentation on how the platform works including video training, PDF maps of all the automations, as well as documentation on all the lists, custom fields and tags that are being used inside your platform. We will then have a 60 minute onboarding session with you where we can show you through the platform in detail and work through any customization you may require to the platform.

SECTION 3 – ONGOING SERVICE FEE

Once your platform has been set up and you have completed your onboarding call you will then be required to pay your Ongoing Service Fee of US$299 per month for a minimum of 6 full months.

Your monthly service fee covers; the cost of your Go High Level software, use of the platform and automations within, email & phone support, live chat support, video training resources, weekly Office Hours zoom calls, integration with the platform to your website, and more. All fees are paid in advance at the beginning of the month. All charges are non-refundable and no-partial refunds will be available for days unused.

SECTION 4 – PAYMENT METHODS

All payments are taken via credit card through Stripe, our third party secure payment provider and no other payment methods are available. Purchase notifications are supplied automatically via Stripe and tax receipts are supplied upon request: [email protected]. SECTION 5 – PAYING YEARLY

If you would like to pay your ongoing service fee yearly you will receive a 15% discount. Contact [email protected] to arrange.

Aside from the training and documentation we provide during the onboarding process (see section 1 of these terms) you can access a library of video training at https://www.dancesites.co/training/, by attending any of the 2 hours of weekly Office Hours calls or by scheduling in support sessions. These sessions can be recorded to aid in the creation of your internal systems, and your team is also able to attend these training sessions.

SECTION 7 – UPGRADING YOUR PACKAGE

You can upgrade from the Go High Level Lite Package to the Go High Level Plus Package at any time. To upgrade your account you need to email [email protected] at least (7) days prior to the desired effective date. Upon receipt of your upgrade request we will; upgrade your Go High Level software to the Plus Plan, add the additional automations, set up the deal pipelines, tasks, landing page builder and other additional features and arrange a (30) thirty minute call to run through the new features.

There are NO additional setup fees to upgrade your platform.

Once upgraded you will need to stay on the Go High Level platform, and at this package level for at least (3) three months, even if you have previously passed the minimum term of (6) six months.

SECTION 8 – DOWNGRADE YOUR PACKAGE

You can downgrade from the Go High Level Plus Package to the Go High Level Lite Package at any time. To downgrade your account you need to email [email protected] at least (7) days prior to the desired effective date. Upon receipt of your downgrade request we will; downgrade your Go High Level software to the Lite Plan, and in doing so remove the additional software features including; deal pipelines, tasks, and landing page builder. We will also remove any automations not included in that package level.

SECTION 9 – ADDITIONAL CONTACTS

Due to the Go High Level software cost being included in the price of Go High Level both our packages come with a set number of contact records. If you require additional contacts in your Go High Level software you will be required to pay the difference in software cost. For example, if Go High Level is charging $10/month for 500 contacts already included in the Go High Level Lite Platform and $70/month for 2,000 contacts you would need to pay an additional $60/month to add the additional contacts to your platform.

SECTION 10 – CANCELLATIONS AND PLATFORM BUYOUT OPTIONS

During your initial (6) six month period, if you choose to cancel your contract with Dance Sites you will be required to pay 75% of the remaining contracted service fees as an early exit fee.

If you cancel your platform after the initial 6 month period there are no exit fees.

If you WANT to buy-out the Go High Level platform we have built for you – including the; automations, forms, content, and training documentation – you will be required to pay a once off buy-out fee of US$2,000 for the Lite Platform or US$3,000 for the Plus Platform. This fee is reduced by 50% if you have had your Go High Level platform for longer than 18 months.

If you DO NOT WANT to buy-out the Go High Level platform we have built for you, we will export all your contact records into a CSV file and provide these to you via email. Then we will schedule your Go High Level account for termination at the end of your billing period. Please note, that data from cancelled accounts is NOT kept on file for privacy reasons.

SECTION 11 – OWNERSHIP

The Go High Level platform, email content, training documentation, video training resources and any other resources supplied by Dance Sites in association with the use of the Go High Level product is the sole property of Dance Sites and must not be copied, distributed or resold.

SECTION 12 – PRIVACY

We take data security very seriously at Dance Sites and make every effort to ensure the safety of your Confidential information.

Confidential Information means information of any kind, including and without limitation, any sensitive or valuable information concerning your studio, your affairs and operations, or your clients contact details.

The Service Provider agrees that they will not at any time during this contract or after it ceases, directly or indirectly disclose or make use of any Confidential Information outside that which is required during the proper performance of this Agreement.

The Service Provider agrees that they will maintain proper and secure custody of all Confidential Information; and use best endeavours to prevent the unauthorised use or disclosure of the Confidential Information by third parties.

At the end of this contract, the Service Provider will immediately; deliver to the Client all Confidential Information that is physically capable of delivery, and destroy any Confidential Information contained in their personal computer software or data or elsewhere by erasing it from any media on which it is stored so that the information cannot be recovered or reconstructed.

SECTION 13 – ADDITIONAL LANGUAGES

Go High Level is a multilingual platform (see available languages), however, all the platform content and associated training documentation is provided in English. If you would like to edit the content into another language you would be required to do so in your own time.

SECTION 14 – NO GUARANTEE

We do not promise or guarantee any financial or business return as a result of using this service. You acknowledge and agree that Dance Sites will not be liable for any damages as a result of downtimes, of using this product.

SECTION 15 – ASSIGNMENT

Service Provider reserves the right to assign this Agreement at any time.

SECTION 16 – NOTICES

All notices, requests, demands, and other communications under this Agreement shall be in writing and shall be deemed to have been given on the date of delivery: (1) if delivered personally to the party to whom notice is to be given; (2) if sent by electronic mail with a cc: to sender; or (3) on the third day after mailing by express mail.

SECTION 17 – ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

SECTION 18 – GOVERNING LAW 

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Gold Coast, Australia, , QLD, 4217, Australia.

SECTION 19 – CHANGES TO TERMS OF SERVICE

You can review the most current version of the Terms of Service at any time at this page.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
